This blog was created by Bashian & Farber, LLP to provide a forum where the firm can provide information to our clients, colleagues, and others in the community with news pertaining to developments within the law, copies of articles published by our firm’s attorneys in scholarly journals on legal issues, and to provide information on community events engaged in by our firm and our staff.

While this blog does not seek to offer legal advice or to form any attorney-client relationships with our readers, it is our hope that the information offered within the blog will serve as a useful source of legal information.

Our continuing tradition of expertise in estate planning and litigation, as well as all aspects of elder law, can be linked to the leadership of partner Gary E. Bashian, Esq., past president of the Westchester County Bar Association and holder of an LL.M degree in taxation. Mr. Bashian, who has provided counsel on estates valued over $100 million, also sets a high standard for our work in estate planning including Asset Protective Trusts, both domestic and off shore, Dynasty Trusts, QTIP Trusts (Qualified Terminable Interest Property Trusts), QPRT Trusts (Qualified Personal Resident Trusts), SNT Trusts (Supplemental Needs Trusts), Life Insurance Trusts, Revocable and Irrevocable Trusts, GRAT Trusts (Grantor Retained Annuity Trusts), Charitable Lead Trusts, other specialized trusts, drafting Business Agreements to address estate planning needs (such as in closely held companies), simple and sophisticated will drafting, and litigation in Estates and Trusts.

Irving O. Farber, Esq. is a litigator known for his trial work in areas including personal injury, corporate and commercial matters, guardianship litigation, medical malpractice and attorney malpractice. His extensive medical knowledge is invaluable in Probate and Guardianship matters. As well, he has special expertise involving hospital/physician issues, including medical conduct matters. Mr. Farber also has significant appellate law experience, including the authorship of Appellate briefs and oral argument before the Appellate Division and Court of Appeals, the highest Court of the State of New York. Mr. Farber is widely recognized as an outstanding attorney and for many years served as the co-chairman of the prestigious Judicial Screening Committee of the Westchester County Bar Association where he led the effort to review and rate the credentials of those seeking Judicial office. Mr. Farber has litigated hundreds of trials to verdict throughout the Hudson Valley and New York City Metropolitan area.

James L. Hyer, Esq. is currently an attorney admitted to practice law in the Courts of the State of New York, Southern District of New York and Eastern District of New York, and is also a trained mediator. James has successfully assisted clients in a wide range of areas including discrimination and civil rights violations, matrimonial and family court actions, personal injury claims, sophisticated estate planning, estate and trust litigations, real estate transactions, land use board applications, business and commercial law transactional work and litigations, and litigations and criminal matters, administrative hearings and LGBT issues. James has distinguished himself as a leader within the legal community, having received a leadership award from the Westchester County Bar Association, of which he currently is a member of the Board of Directors, and he is also currently a member of the House of Delegates of the New York State Bar Association. Mr. Hyer regularly publishes legal articles in scholarly journals, provides lectures on legal issues, has taught Continuing Legal Education classes to attorneys, and is a former adjunct professor.
